1. Acceptance of Terms

By accessing or using I Love CSV (ilovecsv.net), including our web app, Progressive Web App (PWA), desktop applications (Windows/Mac/Linux), and Android app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

I Love CSV provides a suite of 50+ professional data processing tools for CSV, Excel, JSON, TSV, and other tabular data formats. Our services include:

• Free Tier: Access to all tools with file size limit of 100KB, 60 API requests per minute
• Pro Plan (€5/month): File size limit of 100MB, 1,000 API requests per minute, ad-free experience
• Premium Plan (€10/month): File size limit of 1GB, 10,000 API requests per minute, API key access, priority support
• Pay-Per-File (€4 one-time): Process one file up to 1MB with 24-hour access to all tools

3. Privacy-First Processing

Our core principle is local-first data processing. Unless explicitly required for specific features (e.g., AI chat, fuzzy deduplication), all data processing occurs locally in your browser using Web Workers and DuckDB-WASM. We do not upload, store, or view your files.

For features requiring server-side processing, data is:

• Transmitted securely via HTTPS
• Processed in-memory only
• Deleted immediately after operation completion
• Never logged or stored on our servers

4. Account Registration & Authentication

Paid plans require account creation via Firebase Authentication. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

5. Payment Terms

Payments are processed through Paddle. By subscribing to a paid plan, you agree to:

• Subscription Billing: Monthly or annual recurring charges until cancellation
• Payment Processing Fees: 5% + €0.50 per transaction (handled by Paddle)
• VAT/Tax: Applicable taxes calculated automatically based on your location
• Currency: Prices in EUR; USD and GBP auto-converted
• Refunds: Within 14 days for annual subscriptions; no refunds for monthly plans or pay-per-file purchases
• Cancellation: Cancel anytime; access continues until end of billing period

6. Usage Limits & Fair Use

Plan limits are enforced to ensure service quality:

• Free Tier: 100KB file size, 60 API requests/minute, operations limited to 50K rows
• Pro Tier: 100MB file size, 1,000 API requests/minute, unlimited operations
• Premium Tier: 1GB file size, 10,000 API requests/minute, unlimited operations, API access (10K calls/month)

Abuse of service (e.g., automated scraping, excessive API calls, denial-of-service attempts) may result in immediate account suspension without refund.

7. API Usage Terms

Premium and Enterprise users with API access agree to:

• Use API keys only for authorized applications
• Not share or publish API keys publicly
• Respect rate limits (10,000 req/min for Premium; custom for Enterprise)
• Cache responses where appropriate to minimize calls
• Accept that API availability is not guaranteed 100% (standard 99.5% uptime SLA)

8. Intellectual Property

Your Data: You retain full ownership of all data you upload or process through I Love CSV. We claim no rights to your data.

Our Software: The I Love CSV platform, including all tools, code, design, and documentation, is protected by copyright and other intellectual property laws. You may not:

• Reverse engineer, decompile, or disassemble our software
• Remove or alter any proprietary notices
• Create derivative works without explicit permission
• Resell or redistribute our services (except via approved white-label licensing)

9. User Content & Responsibilities

You are solely responsible for:

• The legality, accuracy, and appropriateness of your data
• Ensuring you have rights to process the data you upload
• Compliance with GDPR, HIPAA, SOX, and other applicable regulations
• Not uploading malicious files (viruses, malware, etc.)
• Not using the service for illegal activities or to violate third-party rights

10. Prohibited Uses

You may not use I Love CSV to:

• Process data in violation of privacy laws (GDPR, CCPA, etc.)
• Harass, abuse, or harm others
• Impersonate any person or entity
• Distribute spam, malware, or phishing content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Scrape or data-mine our platform without permission

11. Disclaimers & Limitations of Liability

Service "As Is": I Love CSV is provided "as is" without warranties of any kind, express or implied. We do not guarantee:

• Uninterrupted or error-free operation
• Accuracy or reliability of results (always verify critical data)
• Compatibility with all browsers, devices, or data formats
• Preservation of data in case of bugs or system failures

Limitation of Liability: To the maximum extent permitted by law, I Love CSV and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use or inability to use the service.

Maximum Liability: Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or €50 if no payment was made).

12. Data Security

We implement industry-standard security measures:

• HTTPS encryption for all connections
• Firebase Authentication with secure token handling
• Content Security Policy (CSP) to prevent XSS attacks
• Regular security audits and dependency updates
• No persistent storage of user files on our servers

However, no system is 100% secure. You acknowledge that you use the service at your own risk.

13. Third-Party Services

I Love CSV integrates with third-party services, each governed by their own terms:

• Firebase (Google): Authentication and user management
• Paddle: Payment processing and subscription management
• Google Gemini API: AI chat and natural language queries (optional feature)
• Vercel: Hosting and deployment
• Google Analytics: Privacy-friendly usage analytics

We are not responsible for the availability, policies, or actions of these third parties.

14. Desktop & Mobile Apps

Our desktop apps (Electron) and Android app (TWA) provide the same functionality as the web app with additional offline capabilities. By installing these apps, you agree that:

• Apps require disk space and system resources to operate
• Auto-updates may occur to ensure security and features
• Uninstalling the app does not cancel paid subscriptions (must cancel via account settings)
• Platform-specific terms (e.g., Google Play Store Terms) also apply

15. Termination

By You: You may cancel your account at any time via account settings. Paid subscriptions will remain active until the end of the billing period.

By Us: We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service (excessive API calls, circumventing limits, etc.)
• Fail to pay for services rendered

Upon termination, your right to use the service ceases immediately. We may delete your account data (but not your files, as we never store them).

16. Changes to Terms

We may update these Terms from time to time. If changes are material, we will notify users via:

• Email (for registered users)
• In-app notification banner
• Updated "Last modified" date at the top of this page

Continued use of the service after changes constitutes acceptance of the new Terms.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of Italy (jurisdiction of service operator), without regard to conflict of law principles.

Dispute Resolution: Any disputes shall be resolved through:

1. Good-faith negotiation (contact us at info@insightest.app)
2. Mediation if negotiation fails
3. Binding arbitration in accordance with Italian law (if mediation fails)

No Class Actions: You agree to resolve disputes individually, not as part of any class or representative action.

18. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and I Love CSV.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
• Assignment: You may not assign these Terms; we may assign them to a successor entity.
• Force Majeure: We are not liable for failures caused by events beyond our reasonable control (natural disasters, wars, internet outages, etc.).
